In an application by Grahame Patrick Kelly, the Fair Work Commission, by way of a Decision ([2023] FWCFB 64) and Order (PR760701) dated 3 April 2023, ordered that a vote shall be taken by secret ballot (Ballot) to decide whether, in relation to the amalgamated organisation known as the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU), the Mining and Energy Division established under the rules of the CFMMEU should withdraw from the CFMMEU.
The Fair Work Commission further ordered, pursuant to s.102(1A) of the Fair Work (Registered Organisations) Act 2009 (RO Act), that the Ballot be conducted by me as the Designated Official.
In accordance with s.102(1C) of the RO Act & Regulation 86(1) of the Fair Work (Registered Organisations) Regulations 2009 (RO Regulations), I, as the Designated Official conducting the Ballot, hereby, give notice that:
All financial members of the Mining and Energy Division as at 3 April 2023 are eligible to vote in the Ballot.
The Ballot is to be conducted in part as an attendance ballot and in part as a postal ballot. I, as the Designated Official, may elect to conduct a postal ballot in respect of any member where it is not practical or appropriate to conduct an attendance ballot. Additionally, I, as the Designated Official, will conduct a postal ballot in respect of any member that is unable to participate in an attendance ballot.
Please note that if you are voting by postal ballot, your Ballot Paper must be mailed to arrive no later than 5pm on Monday 19 June 2023 to count. It is recommended that you post your vote early to avoid delays in the mail.
